Subscriber Agreement and Terms of Use
Last updated October 30, 2026. Effective on publication.
The short version
These terms are the agreement between you and Volley Solutions LLC ("Volley", "we" or "us") for using VolleySolutions.com, the Volley app, and any Volley subscription you start without a separate signed agreement. Use our services for what they are for. Please do not break them, misuse them, or present our work as yours. Most of our client work runs under a signed agreement, and that agreement wins where the two differ.
Who you are dealing with
Volley Solutions LLC, based in Golden, Colorado. Formal notices on paper go to Volley Solutions LLC, 1100 Johnson Rd #18593, Golden, CO 80402, United States. Everything else, including support, goes to support@volleysolutions.com, which a person reads.
What these terms cover
These terms cover the public website at VolleySolutions.com, the Volley app, the prototype previews in our workspace, and any Volley subscription you buy online or that your organization starts without a separate agreement. If you subscribe, you are a "Subscriber".
When your organization signs a master services agreement, statement of work, order form or similar agreement with us, for example for Volley Relate, Volley Decide, Volley Mirage, Volley Kindling, Volley Signals or our Salesforce and decision science services, that agreement governs that work. These terms apply only where it is silent, and where the two conflict, the signed agreement controls.
Our Privacy Policy explains how we handle personal information and is part of these terms.
By using the website or the app, or by subscribing, you accept these terms. If you do not accept them, please do not use our services. If you accept them for an organization, you confirm that you have authority to bind it, and "you" includes the organization.
Accounts and eligibility
You must be at least 18, or the age of majority where you live, to accept these terms yourself. A student under that age may use the Volley app only with the permission of a parent or guardian, or through a school or program that has accepted these terms. No one under 13 may use our services.
Give accurate information when you register, keep your sign-in details to yourself, and tell us promptly at support@volleysolutions.com if you think someone has used your account without permission. You are responsible for activity in your account. An organization is responsible for the people it gives access to (its "authorized users") and for their compliance with these terms.
The Volley app
The Volley app is free for individuals with a personal email address, for anyone with a .edu address, and for U.S. 501(c)(3) organizations. Teams and organizations that want the full platform subscribe. We may change which features are free, and we will give notice before removing a free feature you use.
The app coaches; it does not decide. Templates, data sources, bias checks and decision profiles are aids to your own judgment, and you stay accountable for your decisions.
Prototypes and previews
Some pages, including the Volley Signals and Library previews in our workspace, are prototypes that show sample data. Their sign-in screen is not a real account and provides no security. Do not enter real or confidential information into them. We may change or remove them at any time.
Subscriptions, fees and taxes
If you buy a subscription, you agree to pay the fees shown at purchase or in your order, in US dollars, plus applicable taxes (other than taxes on our income). A recurring subscription renews for the same period, and we charge your payment method each period until you cancel. A third-party payment processor may handle payments under its own terms. We do not give tax advice.
You may cancel at any time in your account or by writing to support@volleysolutions.com. Cancellation takes effect at the end of the period you have paid for. Fees already paid are not refundable, except where the law or your order says otherwise, or where these terms promise a refund.
We may change prices for future periods. We will tell you at least 30 days before a new price applies to you, and you may cancel before it does.
If a payment is overdue, we may suspend paid features, after telling you, until it is paid.
We may offer free trials and beta access, and we may end them at any time. We will not move you to a paid plan when a trial ends unless you have agreed to it.
Your content
"Your content" means what you or your authorized users put into our services, such as decisions, criteria, journal entries, recordings, files, records and messages. You keep all of your rights in it.
You give Volley a limited, non-exclusive license to host, copy, process, transmit and display your content only as needed to provide and support our services for you, to keep them secure, and to comply with the law. The license ends when your content is deleted, except for copies in routine backups until those backups expire. We do not sell your content.
You confirm that you have the rights and permissions needed to put your content into our services, including the consent of the people it describes where the law requires it, and that doing so does not break a law or anyone else's rights.
You may export your content while your account is open. After an account closes, we may delete its content, so export what you need first.
AI features
Some features use AI to draft, summarize, transcribe, translate, propose criteria or challenge reasoning. AI output can be wrong, incomplete or biased, so review it before you rely on it. In Volley Decide, people set the decision weights and the math is deterministic and shown; AI never sets the weights. In Volley Mirage, a steward approves every item before a donor sees it.
Our services inform decisions; they do not make them. Nothing in them is legal, financial, tax, investment, medical or security advice.
Using our services responsibly
Please do not:
- try to break, overload, probe or get around the security of our services, or access data that is not yours;
- copy, scrape, decompile or reverse engineer our services, or use them to build a competing product, except where the law expressly allows it;
- use bots or scripts to send more requests or messages than a person could;
- upload malware, or content that is unlawful, deceptive, harassing or infringing;
- put anyone at risk, including by publishing or exporting the identity or precise location of a person in a sensitive place without that person's consent and a lawful basis;
- use our services in breach of US export control or sanctions laws; or
- share or resell access beyond your authorized users.
We may suspend or limit access that does any of these. Where we can, we will tell you first and give you a chance to fix the problem. Reporting a security problem in good faith is always allowed, as our Privacy Policy explains.
Our property
Our services, the software behind them, and our methods, templates, libraries, designs and writing belong to Volley or our licensors. While you follow these terms, we give you a limited, non-exclusive, non-transferable and revocable right to use our services for their intended purpose (for an organization, its internal purposes). We reserve all other rights.
If you send us ideas or feedback, we may use them freely without paying you or owing you anything, but we do not claim ownership of them. Please do not send confidential information through the contact form or in an unsolicited email. Doing so does not create a confidential relationship; confidential client information is protected by the client's signed agreement.

Other companies' services
Our services run on and connect with other companies' services, including Salesforce, Calendly, our app platform and AI model providers, and our website links to other sites. Their own terms govern your use of them, and we are not responsible for their content, availability or practices. We remain responsible for our own work.
Changes and availability
We improve our services continually and may add, change or retire features. If we materially reduce the core features of a paid subscription during a period you have paid for, we will tell you, and you may cancel and receive a pro-rata refund for the unused part of that period.
We work to keep our services available, but unless a signed agreement includes a service level, we do not promise that they will be uninterrupted or free of errors.
Disclaimer
Except as these terms or a signed agreement expressly state, our services are provided "as is" and "as available". To the fullest extent the law allows, Volley makes no other warranty, express or implied, including any warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted or secure operation. Some states do not allow these exclusions, so some of them may not apply to you.
Limitation of liability
To the fullest extent the law allows, Volley is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from these terms or our services, even if we were told they were possible. Volley's total liability for all claims under these terms is limited to the greater of the amount you paid Volley for the service in question in the 12 months before the claim arose, or one hundred US dollars.
These limits do not apply to liability that cannot lawfully be limited, such as liability for fraud, or for death or personal injury caused by negligence. Some states do not allow these limits, so they apply to you only as far as the law allows.
Responsibility for claims
If a third party brings a claim against Volley arising from your content, your breach of these terms or your unlawful use of our services, you will defend Volley and pay the resulting reasonable costs, including reasonable attorneys' fees, and any amount awarded or any settlement you approve. We will tell you promptly about the claim, let you control the defense with counsel we reasonably accept, and cooperate with you. This does not cover anything caused by Volley's own breach, negligence or misconduct.
Suspension and ending
You may stop using our services at any time. We may suspend or end your access if you materially breach these terms and do not fix the breach after notice, if your use puts other people or our services at risk, if the law requires it, or if we stop offering the service. If we end a paid subscription for any reason other than your breach, we will refund what you paid for the unused part of the period.
Provisions that by their nature should outlast these terms will survive, including those on your content, our property, the disclaimer, the limitation of liability, responsibility for claims, and governing law.
Copyright complaints
If you believe material on our services infringes your copyright, send our copyright agent a notice that includes:
- your name, address, telephone number and email address;
- a description of the copyrighted work you claim is infringed;
- a description of the material you claim infringes it, and where it is on our services;
- a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner; and
- your physical or electronic signature.
Our copyright agent is Volley Solutions LLC, Attn: Copyright Agent, 1100 Johnson Rd #18593, Golden, CO 80402, United States, support@volleysolutions.com.
If your material was removed and you believe that was a mistake or a misidentification, you may send the copyright agent a counter-notice that includes your name, address, telephone number and signature; the material that was removed and where it appeared; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; and your consent to the jurisdiction of the federal district court for the district where you live (or, if you live outside the United States, any judicial district in which Volley may be found) and to accept service from the person who sent the original notice. We may end the accounts of repeat infringers.
Governing law and disputes
These terms are governed by the laws of the State of Colorado, without regard to its rules on which law applies. Any dispute about these terms or our services will be heard in the state or federal courts located in Denver, Colorado, and you and Volley consent to the jurisdiction of those courts.
Before filing a claim, please write to us at support@volleysolutions.com and give us 30 days to try to resolve it informally. Either party may still ask a court at any time for urgent relief to protect confidential information or intellectual property.
These terms do not require arbitration and do not waive your right to take part in a class action. Nothing in them takes away a right you have under the consumer protection laws where you live.
California users
Under California Civil Code Section 1789.3, California users may send complaints or questions about our services to support@volleysolutions.com or to Volley Solutions LLC, 1100 Johnson Rd #18593, Golden, CO 80402. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
Changes to these terms
We may update these terms, and the date at the top will change when we do. For a material change that affects a paid subscription or your use of the app, we will tell you in advance by email or in the service. Continuing to use our services after a change takes effect means you accept it. A change does not apply to a dispute that arose before it took effect.
Electronic communications
You agree that we may send you notices and other communications electronically, and that they satisfy any legal requirement that they be in writing. This does not affect your statutory rights.
The rest
These terms, together with the Privacy Policy and any order or signed agreement, are the whole agreement between you and Volley about their subject. They replace the Subscriber Agreement and Terms of Use of October 20, 2020. If a provision is held unenforceable, the rest stays in effect. A failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in a merger, acquisition or sale of assets, with notice to you. You and Volley are independent contractors, and nothing in these terms creates a partnership, joint venture, employment or agency relationship. Neither party is liable for a delay caused by events beyond its reasonable control.
